A public sector employee or public servant is all employees of a government department or agency. The Employment Relations Board (ERB) was established after the adoption of the Employment and Industrial Relations Act 2002. Collective bargaining in Malta usually takes place at company level between a single union representing more than 50% +1 of employees as members and a single employer. Collective bargaining usually results in a collective agreement. In the public service, where unions are traditionally stronger, a collective agreement is signed by seven unions.

State bodies/agencies/entities are subject to separate collective agreements which are negotiated for each body. .
